Terms of Service
Please read the following Terms
of Service carefully, as all members are
required to agree to them when signing up for an
account. They may be subject to change at any
time. Any changes will take effect immediately,
and all members will be notified by email that
changes to the Terms of Service have been made.
Provision of Service
The service is provided on an "as is" basis.
Surfers2u will not be liable for any problems
such as loss of data or profits associated with
using the service, and may withdraw the service
at any time. Your use of this service is at your
own risk.
Member Accounts

Only one account is permitted per
individual or computer. If you are found
to have more than one account, all of
your accounts may be terminated, with
the loss of any credits and referrals. |

You are required to provide a valid
email address when signing up for an
account, and that email address must not
point to an automated response service.
It is your responsibility to ensure your
email address is updated if necessary. |

As an account holder, you agree to
accept email from surfers2u providing
details of updates to the site or
service, contests or special offers that
may run from time to time, and any other
information that Surfers2u admin
considers may be of interest to members. |

Should you wish to cancel your account,
you may do so at any time through the
link in the members area. Cancellation
will automatically result in the loss of
all credits and referrals on the
account. If you are an upgraded member
at the time of cancellation, it is your
responsibility to cancel your
subscription payment. If any
subscription payments are made after
cancellation of your account, surfers2u
cannot guarantee to refund them. |

If you hold an upgraded account, and
your monthly subscription payment is not
made, or is made late, your account will
revert to free status until payment is
made. |

You are not permitted to enroll other
members. If you wish to refer new
members, you may do so by directing them
to your referral link, and inviting them
to enroll themselves. If you are found
to have enrolled another member for the
purpose of gaining credits or money,
your account, and any accounts you have
enrolled, may be terminated, with the
loss of any credits and referrals. |

You are not permitted to offer financial
incentives to gain referrals or to pay
for referrals. This includes the use of
services to purchase signups. If you are
found to have offered a financial
incentive for the purpose of gaining
referrals, your account may be
terminated, with the loss of any credits
and referrals. |
Websites in Rotation

At surfers2u, our aim is to provide you
with the best advertising service we
can, and with that aim in mind, we try
not to restrict too much the content of
sites that can be shown in the rotator.
If your site content is legal and family
friendly, it will probably be approved.
To clarify, here is a list of site
content we will
NOT
approve:
* Pornography and adult
content
* Warez
* Hate sites
* Sites where the main language is not
english
* Any content that our staff considers
to be offensive
Other sites that will NOT be
approved are:
* Sites that have more
than one pop-up
* Sites that have a popup that does not
automatically close on exit
* Sites promoting HYIP, paid-to-surf, or
other ponzi programs
* Gifting sites
* Banner farms
* Sites that break frames
* Sites that freeze the surf bar
* Sites that contain viruses or other
harmful content
* Sites that contain script downloads
If your site disrupts the surfing
process in any way, it will not be
approved. |

surfers2u will make every attempt to
ensure that all sites in rotation
conform to the conditions stated in this
ToS. However, surfers2u and its staff
will not be held liable for any site
appearing in the rotator that does not
conform. If you find such a site while
surfing, please report it using the link
in the surf bar. |

surfers2u will not be liable for any
income claims made by sites that are
placed in rotation. |
Use of the Surf Bar
surfers2u is a manual traffic
exchange designed with user participation in
mind. Auto-click, auto-refresh, or any other
programs that are designed to automate the
surfing process are not permitted. If you are
found to be using such a program, your account
will be terminated with the loss of all credits
and referrals.
Promoting surfers2u
You are permitted to use any legal and
ethical means to promote the surfers2u service,
including, but not limited to, placing your
affiliate site or links to it on other traffic
exchange services, forums and other websites,
where permitted. You may not use unsolicited
commercial email or SPAM to promote your
affiliate site. If you are found to have done
this, your account will be terminated with the
loss of all credits and referrals.
Transfer of Credits
Credits may be transferred between members
and their referrals using the transfer credits
option in the members area. Credits may not be
sold, or given in exchange for any other product
or service.
Payments
Commission payments are made on request when
the account balance exceeds or is equal to $6.
Payments are made by PayPal or AlertPay, and
will be processed within 5 days of the request
being received. We will make every effort to pay
commissions on time to the payment processor you
request. However, we cannot be held responsible
for delays caused by processor site maintenance
or downtime, errors in the information you have
provided, or any other event that is beyond our
control.
Refunds
All sales of upgraded accounts and credits
are final, and no refunds will be given.
DISCLAIMER OF
WARRANTIES, LIMITATION OF LIABILITIES,
INDEMNIFICATION
Surfers2u does not warrant that the website
and service will be error free or uninterrupted.
The website and service is provided on an "as
is" basis without warranties of any kind, either
expressed or implied.
surfers2u will not be responsible for any
losses, damages or costs that you and/or your
business may suffer when using the website or
service. You agree to indemnify and hold
harmless surfers2u from any claims resulting
from your use of the website or service.
You expressly agree that use of the website
or service is at your sole risk. Neither surfers2u nor its service providers, agents,
licensors or employees shall have any liability
for any damages suffered by you or any other
party as a results of the use or misuse of the
service.
COPYRIGHT
All content included on this site, such as
text, graphics, logos, button icons, images,
audio clips and software, is the property of
surfers2u or its content suppliers and protected
by international copyright laws. No part of this
website may be reproduced or transmitted in any
form or by any means without written permission
from the authors. |
